Mayer Brown’s Isle of Wight Office was instructed by Mr and Mrs Grant to provide planning and detailed civil engineering infrastructure design services for a residential development of fourteen dwellings on a sloping greenfield site on the outskirts of the Islands main conurbation of Newport.
Having already helped secure planning consent through transport planning, layout design, drainage and flood risk services, we were then asked to assist with discharging the remaining planning conditions and making a material start on site.
However, one significant issue remained: concerns regarding capacity within the public foul sewer network.
Working alongside the client’s Town and Country Planner, our team carried out detailed negotiations with the Isle of Wight Council and Southern Water. We analysed sewer capability, submitted a Section 106 connection application under the Water Industry Act and provided detailed technical and legal justification to demonstrate that the planning condition and sewer connection process should be treated separately.
Following extensive discussions, submissions and site meetings, we successfully demonstrated that capacity was available. The planning condition was discharged and our clients were able to make a material start, preserving their multi-million-pound planning consent and removing the risk of it lapsing before the site could be sold.
This project demonstrates that successful development planning often requires more than strong technical design. Our understanding of legislation, planning precedents an approval processes was equally important in achieving a positive outcome for the client.
